The City Council of the City of New Hampton met in special session in the Council Chambers at 112 East Spring Street, New Hampton Iowa at 9:00 a.m. Wednesday, May 29, 2024. The meeting was called to order by Mayor Geerts at 9:00 a.m. Council members present were Porath, Denner (Via Telephone) Fisher, Humpal, Larsen. Speltz was absent. Also in attendance were Public Works Director Casey Mai, City Attorney Todd Prichard via telephone, Tyler Hansen and Attorney Kevin Visser.

Moved by Larsen, seconded by Humpal; that the agenda be approved as presented. Ayes – Five. Nays – None. Absent – Speltz. Motion carried.

Speltz arrived at 9:02 am.

City Attorney Todd Prichard and Public Works Director Casey Mai have received information from Precision of New Hampton regarding the existing litigation between the two entities. Representatives for Precision of New Hampton are willing to pay for the expense of relocating the storm sewer lines so access is not a detriment to the City of New Hampton. Precision is securing $125,000 for the cost of relocation and will cooperate with city officials during the construction of the new storm sewer lines. Mai also shared his concerns regarding the need to have a Storm water Management Plan in place. Hansen is aware and willing to comply with all City regulations and requirements

Moved by Fisher, Seconded by Larsen; that resolution No. 6641 A RESOLUTION BETWEEN THE CITY OF NEW HAMPTON AND PRECISION OF NEW HAMPTON REGARDING THE APPROVAL OF A BUILDING PERMIT FOR THE CONSTRUCTION OF 140’ X 297’ BUILDING AND AGREEMENT ENDING PENDING LITIGATION REGARDING SAID BUILDING PERMIT, be approved. Ayes – Porath, Speltz, Denner, Fisher, Humpal, Larsen. Nays – None. Absent – None. Resolution approved.

Prichard and Visser will prepare the agreement.

Moved by Humpal, seconded by Speltz; that the meeting adjourn at 9:29 AM . Ayes – Six. Nays – None. Absent – None. Motion carried.
