The City Council of the City of New Hampton met in regular session in the Council Chambers at 112 East Spring Street, New Hampton Iowa at 7:00 p.m. Monday, August 16, 2021. The meeting was called to order by Mayor Schwickerath at 7:00 p.m. Council members present were Perkins, Boos, Denner, Diiro and Fisher.  McDonald was absent.  Also in attendance were Zach Nosbisch, Casey Mai, Tammy Robinson, Chad Dungey, Mark Kipp, Megan Nosbisch, Brandy Salinas and City Attorney Kevin Kennedy.

 

Moved by Perkins, seconded by Boos; that the agenda be approved as presented. Ayes-Five. Nays-None. Absent– McDonald.  Motion carried.

 

Moved by Diiro, seconded by Perkins; That the minutes of the regular council meeting of August 2, 2021, be approved. Ayes-Five. Nays-None. Absent– McDonald.  Motion carried.

 

Moved by Perkins, seconded by Denner; That the claims in the amount of $57,904.95 be approved.  Ayes-Five. Nays-None. Absent– McDonald.  Motion carried.

 

7:00 PM PUBLIC HEARING RE: SALE OF CITY PROPERTY

Mayor Schwickerath announced now is the time and place fixed for the public hearing to receive public comment with regard to accepting bids for the sale of real estate.  The property is described as follows:

A parcel located in the South Half of Section 7, Township 95 North, Range 12 West of the 5th P.M., Chickasaw County, Iowa, and more particularly described as follows  Beginning at the Southeast corner of Lot 1, Bowers Addition to New Hampton;  Thence West along the South Lot Line of said Lot to the Southwest Corner of said Lot;  Thence South 88°-38’-23” West 304.77 feet to the West Line of the Southwest Quarter of the Southeast Quarter, thence South 00°-40’-29”East 22.50 feet;   Thence South 00°-40’-29” East 22.50 feet along said West Line;  Thence North 88°-38’-23” East 217.93’ to the Northwest Corner of Lot 2, Block 3, Tank’s 2nd Addition to the City of New Hampton;  Thence East along the North Line of said lot to the Northeast Corner of Block 3, Tank’s 2nd Addition to the City of New Hampton;  Thence North along the Westerly Right of Way of First Avenue to the Point of Beginning.

 

The Council investigated and found that the time and the place of the hearing had in accordance with the law and directed by the City Council been published in the New Hampton Tribune on the 10th day of August, 2021 in New Hampton in the County of Chickasaw.  Mayor Schwickerath asked for oral comments.  There were none.  The Mayor Schwickerath asked for written comments.  There were none.  There being no further comments, or evidence offered, the Mayor announced the hearing closed.

Moved by Boos, seconded by Denner: that Resolution No. 6485  A Resolution to ACCEPTING THE BID OF MELROSE WOODS, LLC in the amount of $250.00 for the land on south first avenue MEASURING 22.5’ X 420’, be approved.  Ayes – Perkins, Boos, Denner, Diiro, Fisher.  Nays – None.  Absent – McDonald.  Resolution approved.

 

Public Works Director Casey Mai accepted bids for a 5 year sanitary sewer cleaning and televising project. He presented the council with a summary of all the potential costs and recommended Visu-Sewer’s proposal for a 5 year project be approved.  Moved by Denner, seconded by Diiro; that Resolution No. 6486 A Resolution to ACCEPTING THE BID OF Visu-Sewer in the amount of $225,875.00 for the MULTI-YEAR 2021-2026 SANITARY SEWER CLEANING & TELEVISING, be approved. Ayes – Perkins, Boos, Denner, Diiro, Fisher.  Nays – None.  Absent – McDonald.  Resolution approved.

 

 

Mayor Schwickerath presented the Todd Prichard Law Firm as a candidate for retiring city attorney Kevin Kennedy.  Prichard was unable to attend the meeting but has agreed to serve at city attorney.  Moved by Fisher, seconded by Denner; That the appointment of the Todd Prichard of Prichard Law Firm to serve as City Attorney for the City of New Hampton be effective on September 1, 2021 with a monthly fee of $3,051.00, be approved.  Ayes – Perkins, Boos, Denner, Diiro, Fisher. Nays-None. Absent– McDonald.  Motion carried.

 

 

The TRIBE Trail Committee would like the council’s permission to install the trail on the east side of Linn Ave. from the end of the trail near Oval’s office, north to the existing sidewalk at 516 South Linn.  Moved by Boos, seconded by Perkins; To grant permission to the TRIBE Trail Committee to continue the TRIBE Trail in the Right Of Way on the east side of South Linn Avenue to 516 S. Linn Ave, be approved.  Ayes-Five. Nays-None. Absent– McDonald.  Motion carried

 

New Horizons – Chamber office is requesting street closures for the event ‘So Long to Summer’ being held on September 9, 2021.  Moved by Denner, seconded by Diiro; That the street closure request for Thursday, September 9th include the following:

  1. North Walnut between West Main Street and the north alley from 8:00 am through 5:00 pm
  2. South Walnut from Main Street to West Spring street for Classic Car night from 4:30 pm–9:00 pm
  3. South Chestnut from Main Street to the alley from 9:00 am to 5:00 pm, be approved.

 

Ayes-Five. Nays-None. Absent– McDonald.  Motion carried

 

Brandi Salinas, owner of The Locker Room, requested to close North Walnut between the alley and West Prospect for a bean bag tournament and live music event from 9:00 am through 11:00 pm on August 28th, 2021. Salinas would like to leave the alley open for vehicle access issues.  Salinas will talk to adjoining neighbors prior to the event.  Moved by Perkins, seconded by Denner; That the street closure request for the Locker Room event on Saturday, August 28th for North Walnut between the alley and West Prospect, be approved. Ayes – Five. Nays – None. Absent– McDonald.  Motion carried.

 

Residents Chad and Sarah Dungey are requesting to remove their existing sidewalk along West Spring Street.  The existing sidewalk is not connected to the neighbors to the west.  The Council requests the Dungey’s sign the Sidewalk Removal Agreement which states they are required to reinstall the sidewalk if the resident to the west installs sidewalk. Moved by Diiro, seconded by Fisher; That Chad Dungey remove the sidewalk along West Spring street that is adjacent to his address at 15 South Sherman, and sign the Sidewalk Removal Agreement that requires them to reinstall the sidewalk if the resident to the west installs a sidewalk, be approved. Ayes – Five. Nays – None. Absent– McDonald.  Motion carried

 

Moved by Perkins, seconded by Fisher; To approve the appointment of Megan Nosbisch to the Library board, for a term ending July 1, 2027, be approved. Ayes-Five. Nays-None. Absent– McDonald.  Motion carried.

 

Moved by Denner, seconded by Boos; That Schueth Ace Hardware, located at 6 West Main Street, Class B Native Wine Permit WBN000520, be approved. Ayes – Five. Nays – None. Absent– McDonald.  Motion carried

 

Moved by Perkins, seconded by Denner;   That the finance reports for July, 2021 be accepted and place on file.  Ayes-Five. Nays-None. Absent– McDonald.  Motion carried.
