The City Council of the City of New Hampton met in regular session in the Council Chambers at 112 East Spring Street, New Hampton Iowa at 7:00 p.m. Monday, August 2, 2021. The meeting was called to order by Mayor Schwickerath at 7:00 p.m. Council members present were Fisher, McDonald, Perkins and Boos. Diiro and Denner were absent.  Also in attendance were Zach Nosbisch, Casey Mai, Tammy Robinson, Bob Fenske and City Attorney Kevin Kennedy.

 

Moved by Perkins, seconded by Boos; that the agenda be approved as presented. Ayes-Four. Nays-None. Absent– Diiro and Denner.  Motion carried.

 

Moved by McDonald, seconded by Perkins; That the minutes of the regular council meeting of July 19, 2021, be approved. Ayes-Four. Nays-None. Absent– Diiro and Denner.  Motion carried.

 

Moved by Perkins, seconded by McDonald; That the claims in the amount of $41,711.96 be approved.  Ayes-Four. Nays-None. Absent– Diiro and Denner.  Motion carried.

 

7:00 PM PUBLIC HEARING FOR URBAN RENEWAL AMENDMENT

The notice of the intention of the Council to conduct a public hearing on the 2021 Amendment to the urban renewal plan for the New Hampton Urban Renewal Area related to adding property to the Urban Renewal Area, had been published according to law and as directed by the Council and that this is the time and place at which the Council shall receive oral or written comments from any resident or property owner of the City.  The Mayor asked for oral comments.  There were none.  The Mayor asked for written comments.  There were none.

There being no further comments, or evidence offered, the Mayor announced the hearing closed.

Moved by Council Member McDonald, the adoption of a Resolution No. 6482 A Resolution to Approve 2021 Urban Renewal Plan Amendment for the New Hampton Urban Renewal Area, seconded by Council Member Boos, be approved.  Ayes – Fisher, McDonald, Perkins, Boos. Nays – None.  Absent- Denner, Diiro.  Resolution approved.

 

Moved by McDonald, seconded by Perkins; That Resolution No. 6483 a resolution approving the section 125 premium only plan for the employee share of the heath insurance premium, for plan year ending September 30, 2022, be approved.  Ayes – Fisher, McDonald, Perkins, Boos. Nays – None.  Absent- Denner, Diiro.  Resolution approved

 

City Attorney Kevin Kennedy reported that the variance request for Jack and Jenny van der Meer for a side yard setback was granted by the Board of Adjustment and they may construct their addition to the garage.

 

New Hampton resident, Dale Reicks, is working on a housing development near South 1st Ave.  Reicks is interested in purchasing a 20’ x 420’ (approximate) strip of land that is owned and maintained by the city of New Hampton to assist with his development.  The City of New Hampton would maintain an easement for the property for utility purposes.  Moved by Perkins, seconded by McDonald; That RESOLUTION NO 6484 A RESOLUTION SETTING DATE OF PUBLIC HEARING FOR AUGUST 16, 2021 TO HEAR CITIZEN COMMENTS REGARDING THE SALE OF CITY PROPERTY, WITH THE RIGHT TO REJECT ANY AND ALL BIDS, be approved.  Ayes – Fisher, McDonald, Perkins, Boos. Nays – None.  Absent- Denner, Diiro.  Resolution approved.

 

Moved by Fisher, seconded by Boos; That Fareway Stores, located at 102 South Water Ave., Class E Liquor License #LE0001727, be approved.  Ayes-Four. Nays-None. Absent– Diiro and Denner.  Motion carried.

 

Mayor Schwickerath reported to the council that he has spoken with 2 candidates for the city attorney position.  The first applicant will have a legal representative at each council meeting and would be paid the same rate currently being paid to Kennedy.  The second applicant would charge $175.00 per hour and would only attend meetings when needed.  The Council would like the city attorney to attend all council meetings.  Mayor Schwickerath will reach out to the preferred candidate and the item will be presented at the August 16, 2021 city council meeting.

 

Moved by Perkins, seconded by Fisher; That the minutes and correspondence be accepted and placed on file, be approved.  Ayes-Four. Nays-None. Absent– Diiro and Denner.  Motion carried.

McDonald commended the city staff that was responsible for updating the City of NH website.

 

Clemens reported that the first half of the American Rescue Plan Act relief money of $ 253,787.30 was deposited into the city’s account today.

 

Moved by Boos, seconded by McDonald; that the meeting adjourn at  7:23 p.m. Ayes-Four. Nays-None. Absent– Diiro and Denner.  Motion carried.
