The City Council of the City of New Hampton met in regular session on Zoom.com at 7:00 p.m. Monday, December 7, 2020. The meeting was called to order by Mayor Schwickerath at 7:00 p.m. Council members present via Zoom.com were Denner, Diiro, Kuhn, McDonald, Perkins and Boos. Also in attendance via Zoom.com were Zach Nosbisch, Eric Kuehn, Rick Kramer, Tim Angell, Jeremy McGrath, Randy Kellogg, Tammy Robinson, Micheal Brincks, Neil Jones of SOO Green, and City Attorney Kevin Kennedy.

Moved by Perkins, seconded by Diiro; The agenda be approved as presented. Ayes- Denner, Diiro, Kuhn, McDonald, Perkins, Boos. Nays – None. Absent –None. Motion carried.

Moved by Denner, seconded by Boos; That the minutes of the November 16, 2020 regular Council meeting, be approved Ayes- Denner, Diiro, Kuhn, McDonald, Perkins, Boos. Nays – None. Absent –None. Motion carried.

Moved by Denner, seconded by Perkins; That claims in the amount of $257,122.26 be approved. Ayes- Denner, Diiro, Kuhn, McDonald, Perkins, Boos. Nays – None. Absent –None. Motion carried.

Moved by Boos, seconded by Perkins; That an Ordinance entitled AN ORDINANCE AMENDING SCHOOL STOPS, receive its second consideration. Ayes- Denner, Diiro, Kuhn, McDonald, Perkins, Boos. Nays – None. Absent –None. Motion carried. Mayor Schwickerath ordered the item be on the agenda at the next regular council meeting for its third and final consideration.

Moved by McDonald, seconded by Diiro; That an Ordinance entitled AN ORDINANCE REDUCING MEMBERSHIP ON THE BOARD OF PARK AND REC COMMISSIONERS, receive its second consideration. Ayes- Denner, Diiro, Kuhn, McDonald, Perkins, Boos. Nays – None. Absent –None. Motion carried. Mayor Schwickerath ordered the item be on the agenda at the next regular council meeting for its third and final consideration.

Councilmember Denner questioned if ATV vehicles were included on the ordinance change for golf carts and utility vehicles. After discussion, it was decided to amend the Snowmobile Ordinance to include ATV’s being driven in the city limits. It will be discussed at a future meeting. Moved by McDonald, seconded by Diiro; That an Ordinance entitled AN ORDINANCE REVISING GOLF CARTS AND UTILITY VEHICLES, be approved. Ayes- Denner, Diiro, Kuhn, McDonald, Perkins, Boos. Nays – None. Absent –None. Motion carried. Mayor Schwickerath ordered the item be on the agenda at the next regular council meeting for its third and final consideration.

Casey Mai has accepted the City of New Hampton offer to be Public Works Director and plans on starting on January 1, 2020. Moved by Perkins, seconded by Diiro; That Casey Mai be hired at Public Works Director with an annual salary of $75,000 with a reimbursement up to $2,500 moving expenses and receive the same benefits offered to City of New Hampton employees, be approved. Ayes- Denner, Diiro, Kuhn, McDonald, Perkins, Boos. Nays – None. Absent –None. Motion carried.

Neil Jones from Direct Connect presented a short video on plans to build an Underground High Voltage Direct Current Transmission Project from Mason City, Iowa to Yorkville, Illinois. The SOO Green project will be boring into the ground along the railroad right of way. There will be a franchise agreement with the City of New Hampton; it will be presented to the City Attorney in the near future.

Moved by Perkins, seconded by Denner; That street department employee Eric Kuehn, be promoted to Street Supervisor and receive a $23.55/per hour wage, retroactive to October 19, 2020; and with a six-month review, based on the review, a wage increase to $24.59, be approved. Ayes- Denner, Diiro, Kuhn, McDonald, Perkins, Boos. Nays – None. Absent –None. Motion carried.

As of result of Tim Angell’s pending retirement on January 1, 2021, Jerry Heying will be assuming the Grade 4 responsibilities of the WWTP. DNR has allowed Heying’s Grade 3 certification to be temporarily adequate, until a Grade 4 employee is in place. There has been discussion to increase his wages due to his additional responsibilities. His current wage is $22.92. Moved by Diiro, seconded by Kuhn; That water/wastewater employee, Jerry Heying, and receive a

$24.92/per hour wage, effective January 4, 2021, be approved. Ayes- Denner, Diiro, Kuhn, McDonald, Perkins, Boos. Nays – None. Absent –None. Motion carried.

Park & Rec Director, Rick Kramer, is requesting to close East Spring Street between South Locust and South Water from 8:30 – 10:30 am on Saturday December 12th. As of result of COVID, Breakfast with Santa will be a drive thru event. Moved by Kuhn, seconded by Perkins; To approve the street closure request of the Park & Rec Department for the “Breakfast with Santa – Drive Through’, be approved. Ayes- Denner, Diiro, Kuhn, McDonald, Perkins, Boos. Nays – None. Absent –None. Motion carried.

The resident at 308 North Pleasant Hill is requesting a curb cut of an additional 29’. They would like to have a curb cut from the south end of their existing driveway approach 29’ to the south. Moved by Boos, seconded by Perkins; That the curb cut of 29’ be approved for 308 North Pleasant Hill. Ayes- Denner, Diiro, Kuhn, McDonald, Perkins, Boos. Nays – None. Absent –None. Motion carried.

Toby Schwickerath, New Hampton Fire Chief, presented the annual wages for the Fire Department Staff for calls from December 2019 thru November 2020. Moved by Perkins, seconded b Diiro; That the wages for fire department employees, from December 1, 2019 through November 30, 2020 in the amount of $46,235.00, be approved. Ayes- Denner, Diiro, Kuhn, McDonald, Perkins, Boos. Nays – None. Absent –None. Motion carried.

Moved by McDonald, seconded by Kuhn; That the application for liquor license #LC0039605 for Butch’s at 4 East Main Street, be approved. Ayes- Denner, Diiro, Kuhn, McDonald, Perkins, Boos. Nays – None. Absent –None. Motion carried.

Moved by Denner, seconded by Kuhn; That the council go into a closed session pursuant to Iowa Code Section 21.5(1)(c), which provides: To discuss strategy with counsel in matters that are presently in litigation or where litigation is imminent where its disclosure would be likely to prejudice or disadvantage the position of the governmental body in that litigation. Ayes- Denner, Diiro, Kuhn, McDonald, Perkins, Boos. Nays – None. Absent –None. Motion carried.

The Council entered closed session at 8:15 p.m.

The Council resumed open session at 9:01 p.m.

Moved by McDonald, seconded by Diiro; That council member Scott Perkins be designated to represent the City of New Hampton at the Settlement Conference on December 21, 2020 at 9:00 am regarding the lawsuit filed by Chickasaw County regarding funding a county wide ambulance service. Ayes- Denner, Diiro, Kuhn, McDonald, Perkins, Boos. Nays – None. Absent –None. Motion carried.

Attorney’s Kevin Kennedy and Kit O’Donohoe, Lt Plant Manager Brian Quirk and City Clerk Karen Clemens previously met to discuss request of LTD Broadband LLC request to install small cell appliances on the city’s and light plant’s utility poles. The city/utility may charge $500 for an application that includes up to five small wireless facilities, with an additional $50 for each small wireless facility beyond five. Recurring fees, including any possible ROW access fee or attachment fee, shall not exceed $270 per small wireless facility per year. The initial request from LTD requested the use of 19 poles. Moved by Denner, seconded by Kuhn; That Resolution No. 6451 A RESOLUTION TO ESTABLISH SMALL CELL ATTACHMENT FEE OF $270 PER SMALL WIRELESS FACILITY PER YEAR AND A PERMIT FEE OF $500.00 FOR THE 1ST 5 POLES, AND AN ADDITIONAL $50 FOR EACH SMALL WIRELESS FACILITY BEYOND FIVE, be approved. Ayes- Denner, Diiro, Kuhn, McDonald, Perkins, Boos. Nays – None. Absent –None. Resolution passed.
