The City Council of the City of New Hampton met in regular session in the Council Chambers at 112 East Spring Street, New Hampton Iowa at 7:00 p.m. Monday, February 15, 2021. The meeting was called to order by Mayor Schwickerath at 7:00 p.m. Council members present were Fisher, McDonald, Perkins, Boos, Denner and Diiro. Also in attendance were Zach Nosbisch, Casey Mai, Tammy Robinson, Alan Powell with Jendro Sanitation and City Attorney Kevin Kennedy.

Moved by Perkins, seconded by Diiro; the agenda be approved as presented. Ayes – Six. Nays – None. Absent – None. Motion carried.

Moved by Diiro, seconded by Fisher; That the minutes of the regular council meeting of February 1, 2021, be approved. Ayes – Six. Nays -None. Absent – None. Motion carried.

Moved by Perkins, seconded by Boos; that claims in the amount of $118,689.83 be approved. Ayes-Six. Nays – None. Absent –None. Motion carried.

7:00 PM PUBLIC HEARING FOR MAX LEVY RESOLUTION
Mayor Schwickerath announced now is the time and place fixed for the public hearing on the proposed Maximum Property Tax Dollars Levy proposed for the fiscal year beginning July 1, 2021 and ending June 30, 2022. The Council investigated and found that the time and the place of the hearing had in accordance with the law and as directed by the City Council been published in the New Hampton Tribune on the 2nd day of February 2021 in New Hampton in the County of Chickasaw. Mayor Schwickerath asked for oral comments. There were none. Mayor Schwickerath asked for written comments. There were none. Mayor Schwickerath declared the hearing closed.

Moved by McDonald, seconded by Denner; That Resolution No. 6458 A RESOLUTION APPROVING THE MAXIMUM TAX DOLLARS FROM CERTAIN LEVIES FOR THE CITY’S PROPOSED FISCAL YEAR 2021-2022 BUDGET, be approved. Ayes – Fisher, McDonald, Perkins, Boos, Denner, Diiro. Nays-None. Absent – None. Resolution approved.

Moved by Boos, seconded by Perkins; That the proposed ORDINANCE NO. 881 AMENDING LOUD AND RAUCOUS NOISE AS DISORDERLY CONDUCT receive its third and final consideration, be approved. Ayes – Fisher, McDonald, Perkins, Boos, Denner and Diiro Nays-None. Absent-None. Ordinance adopted. Mayor Schwickerath ordered Ordinance No. 881 duly adopted.

Moved by Perkins, seconded by Fisher; That Resolution No. 6459 A RESOLUTION TO SET A PUBIC HEARING ON MARCH 1, 2021 AT 7:00 PM AT THE CITY COUNCIL MEETING TO HEAR CITIZEN COMMENTS ON THE FY 2021-2022 PROPOSED BUDGET, be approved. Ayes – Fisher, McDonald, Perkins, Boos, Denner and Diiro Nays-None. Absent-None. Resolution approved.

Public Works Director Casey Mai shared with the council correspondence he received from Steve Troyer of Fox Engineering for an agreement for engineering services for the facility plan for the WWTP and the Nutrient Reduction Strategy. Mai is looking for council direction on how he should proceed with possible financing options for these two items. The Nutrient Reduction Strategy needs to be completed by 2022 and the entire plant needs to be in compliance by 2032. The Facility Plan will tell the Council the specifics of how to plan and prepare for such a large project Mai has also received information about the State Revolving Loan Fund (SRF) which provides low interest rates on loans through the State of Iowa. He could utilize this money to pay for the $39,300 agreement with Fox Engineering. Moved by Denner, seconded by McDonald; To direct Public Works Director Casey Mai to continue with SRF loan application with the State of Iowa and direct Mayor Schwickerath to sign the necessary documents for the loan, be approved. Ayes – Six. Nays – None. Absent – None. Motion approved. Mai will present additional information at the March 1, 2021 council meeting.

On February 1, 2021, Alan Powell with Jendro Sanitation presented a proposal to change the New Hampton recycling program to the Sanitation Committee, He is requesting all city residents use a 65 gallon recycling bin/tote, which Jendro will provide, which will allow the recycling pickup to be automated. With the purchase of the totes, he is requesting a $1.25 rate increase per resident, per month. He acknowledged that this change is only for recyclables but someday he plans to automate the garbage pickup using bins as well. Powell is not sure when the bins for automated garbage pickup will start.

City Attorney Kennedy questioned Jendro’s plan to discontinue glass pickup which is contrary with Iowa State Law to reduce landfill waste. Jendro will continue to pick up clear glass until the garbage pickup changes to bins. Kennedy also shared with the Council that Finance Chair Scott Perkins and City Clerk Karen Clemens reviewed Jendro’s Financial records. Moved by Diiro, seconded by McDonald; Authorizing City Attorney Kevin Kennedy to prepare an addendum to the existing contract with Jendro Sanitation to include the addition of the 65 gallon tote and 5 year extension of the contract. Ayes – Six. Nays – None. Absent – None. Motion carried.
Moved by Denner, seconded by Perkins; That the tax exemption under the City of New Hampton Urban Renewal Revitalization Plan for David & Emily Smith, be approved. Ayes – Six. Nays – None. Absent – None. Motion carried.

Moved by Denner, seconded by Fisher; That the following establishments have their liquor licenses renewed:

  • #LC0035934 – The Pub at the Pinicon
  • #LC0041464 – New Josies, LLC
  • #LC0040761 – Rancho Viejo Mexican Restaurant
