The City Council of the City of New Hampton met in regular session in the Council Chambers at 112 East Spring Street, New Hampton Iowa at 7:00 p.m. Tuesday, July 5, 2022. The meeting was called to order by Mayor Schwickerath at 7:00 p.m. Council members present were Speltz, Daly, Denner, Fisher and Humpal. McDonald was absent. Recently, the Governor signed into law several changes to the State Laws regulating ATV/UTV’s and Police chief Nosbisch has requested an ordinance change to reflect the new laws. Moved by Denner, seconded by Fisher; That the proposed ordinance AN ORDINANCE APPROVING AMENDMENTS TO THE ATV/UTV REGULATIONS receives its second consideration. Ayes – Speltz, Daly, Denner, Fisher and Humpal. Nays – None. Absent – McDonald. The Mayor requested the proposed ordinance be placed on the July 18, 2022 regular council meeting agenda for its third and final consideration.
Police Chief Nosbisch discussed the lack of applicants for the open officer position. He is looking for suggestions to attract candidates, certified or uncertified. Nosbisch provided a list of other cities’ benefit package for new employees in comparison to New Hampton’s. He would like to raise the starting wage and increase the residency requirement from a 10 mile radius to 30 mile radius. The Council agreed that raising the pay rate is necessary to attract applicants, but this also involves changing the Local Union No. 2003 agreement. After a lengthy discussion, Denner moved, Humpal seconded; To direct City Attorney Todd Prichard to prepare a request to the Local Union No.2003 representatives to consider opening the union contract negotiations to consider increasing the police department’s hiring wage. The Council continued their discussion of utilizing the Local Option Sales Tax to pay for the possible upcoming ambulance expenses. Clemens told the Council that the request should be given to the Chickasaw County Auditor’s office by August 1, 2022 to have the issue be on the General Election Ballot on November 8th, 2022. Denner motioned to table the issue until the July 18th City Council meeting. There was no second to the motion.
Mayor Schwickerath appointed Council members Speltz, Fisher and City Clerk Clemens to serve on the LOST Committee to promote and inform the New Hampton residents about the ballot request. Moved by Daly, seconded by Fisher; To direct City Attorney Prichard and City Clerk Clemens to prepare the ballot request and submit to the Chickasaw County Auditor before August 1, 2022 to be placed on the General Election ballot on November 8, 2022, be approved. Resident Jill Samec is building a new residential home at 717 East Jefferson Street and is requesting to not install a sidewalk. Council directed Clemens to prepare a sidewalk agreement for Samec which requires the property owner to install a sidewalk if they adjoining owners install one. Moved by Denner, seconded by Humpal: That Jill Samec, the resident at 717 East Jefferson Street, is granted a waiver to not install a sidewalk and to sign a Sidewalk Removal Agreement, be approved. Fidelity Bank employee, Brad Shatek, has requested to extend their use of the three parking spaces for customer drive up until August 5, 2022. Moved by Fisher, seconded by Speltz, that Fidelity Bank & Trust, located at 25 North Chestnut Ave., designate the three parking spots on the west side of their building as ‘curbside banking’ spots, continue through August 5, 2022, be approved. Mayor Schwickerath updated the council on the Committee Meeting as a Whole at 6:00 pm. The Committee reviewed the proposed 28E Agreement prepared by the Chickasaw County Attorney. City Attorney Prichard would like stronger wording in the obligation section and include a mechanism for the City to receive a refund, if applicable. Prichard’s second concern was with Item #18 and the Obligations of the City and the liability of the city. The contract should read that the County shall indemnify and hold harmless the City of New Hampton from any and all claims. The council members agreed with Prichard’s concerns and requested he prepares proposed statements to share with the Chickasaw County Board of Supervisors.
Moved by Daly, seconded by Council Member Denner; that Resolution No 6529 A RESOLUTION TO ADOPT A CODE OF CONDUCT, be approved. Ayes – Speltz, Daly, Denner, Fisher and Humpal. Absent – McDonald. Resolution adopted. City Clerk will also provide the Code of Conduct to all staff, board members and commissioners if they chose to sign the document.
