The City Council of the City of New Hampton met in regular session in the Council Chambers on Monday, July 6, 2020 at 7:00 p.m.

The meeting was called to order by Mayor Schwickerath at 7:00 p.m. Council members present were Denner, Kuhn, McDonald, Perkins and Boos. Diiro was absent. Also in attendance were Zachary Nosbisch, Tammy Robinson, Jr Mai, Jake Hackman, Jeff Bernatz, Katie Boehmer, Andy Boehmer and City Attorney Kevin Kennedy.

Moved by Perkins, seconded by Boos; The agenda be approved as presented. Ayes- Five. Nays – None. Absent – Diiro. Motion carried.

Moved by McDonald, seconded by Kuhn; That the minutes of the June 15, 2020 regular Council meeting, be approved. Ayes- Five. Nays – None. Absent – Diiro. Motion carried.

Moved by Kuhn, seconded by McDonald; That the payment to Blacktop Service for the seal coating project be held until the tar is removed from the curbs and claims in the amount of $209,451.53 be approved. Ayes- Five. Nays – None. Absent – Diiro. Motion carried.

Mayor Schwickerath announced now is the time and place for the public hearing for Brandy & Santos Salinas, The Locker Room, in connection with the construction of a restaurant, which provides for certain property tax incentives in the form of annual appropriation, incremental property tax payments in a total amount not exceeding $9,000m as authorized by Section 403.9 of the Code of Iowa. The Council investigated and found that the notice of hearing had been published according to law and as directed by the Council on the 30th day of June, 2020 in New Hampton in the County of Chickasaw. There were no oral comments and no written comments. There being no further objections or comments, Mayor Schwickerath declared the hearing closed. Moved by Perkins, seconded by Boos; That Resolution No. 6437 A Resolution APPROVING DEVELOPMENT AGREEMENT WITH BRANDY AND SANTOS SALINAS, AUTHORIZING ANNUAL APPROPRIATION OF TAX INCREMENT PAYMENTS AND PLEDGING CERTAIN TAX INCREMENT REVENUES TO THE PAYMENT OF THE AGREEMENT, be approved. Ayes – Denner, Kuhn, McDonald, Perkins, Boos. Nays – None. Absent- Diiro. Resolution approved.

Jr Mai solicited bids for repairs of the deteriorating bricks in the C-3 District on Main Street. The bids received were as follows:

Moved by McDonald, seconded by Perkins; That Resolution No. 6438 A RESOLUTION APPROVING THE BID OF RANDY BRUMMOND CONSTRUCTION IN THE AMOUNT OF $7,560.48 FOR COLORED AND STAMPED CONCRETE TO REPLACE THE BRICK ON MAIN STREET IN THE C-3 COMMERCIAL DISTRICT be approved. Ayes – Denner, Kuhn, McDonald, Perkins, Boos. Nays – None. Absent- Diiro. Resolution approved.

Fehr Graham reviewed Five Star Coop’s Storm Water Management plan and recommended the City approve. Moved by Perkins, seconded by Boos; That the Storm Water Management Plan of Five Star Coop, be approved. Ayes- Five. Nays – None. Absent – Diiro. Motion carried.

An agreement, prepared by County Attorney Jennifer Schwickerath, provides for the storage of radio/communications equipment in the New Hampton Fire Station which is part of their Communications Capital Project. The equipment is already stored in the Fire Station without a signed contract. It is taking up a 20’ x 30’ area in the Fire Station. Perkins did not feel the City should allow the County to store their equipment in the Fire Station due to the ongoing litigation with the County. Moved by Kuhn, seconded by McDonald; To direct mayor Bobby Schwickerath to sign the agreement between the City of New Hampton, the Chickasaw County Board of Supervisors, Chickasaw County 911 Board and the New Hampton Fire Department for storage of radio/communications equipment, be approved. Ayes- Four. Nays – One. Absent – Diiro. Motion carried.

City Attorney Kevin Kennedy shared the results of the Board of Adjustment request of Andy and Katie Boehmer. The Board voted to allow Boehmer’s request to build a garage with brick accents. Boehmer’s were requesting a variance for a side yard setback, year yard setback, 30% lot size requirements and also a variance for not having similar materials, per the Zoning Ordinance.

City Attorney Kevin Kennedy shared the results of the Board of Adjustment request of Jeramy Croell. The Board voted to allow Croell’s request to build a storage building with brick accents on the South and East side of the building. Croell was requesting a variance for not having similar materials, per the Zoning Ordinance.

Moved by Perkins, seconded by McDonald; To refer the Planning and Zoning Board to discuss accessory building size. Ayes – Five. Nays – None. Absent- Diiro. Motion- Carried.

Moved by Diiro, seconded by Boos; That the application for License #BC0019277 Kwik Star #714 (115 East Main Street), be approved. Ayes- Five. Nays- None. Absent- Diiro. Motion- carried.

Moved by Perkins, seconded by Boos; That the application for Tax Exemption under the City of New Hampton, Iowa Urban Revitalization Plan for Mike Mashek and Phil & Theresa Glaser, be approved. Ayes –Five. Nays – None. Absent – Diiro. Motion carried.

Moved by Kuhn, seconded by McDonald; That the following be accepted and placed on file.
