The City Council of the City of New Hampton met in regular session in the Council Chambers at 112 East Spring Street, New Hampton Iowa at 7:00 p.m. Monday, June 6, 2022. The meeting was called to order by Mayor Schwickerath at 7:00 p.m. Council members present were Humpal, McDonald, Speltz, Daly, Denner and Fisher. Also in attendance were Zachary Nosbisch, Casey Mai, Tammy Robinson, Joshua Schuchardt, Jeremy McGrath, Dixie Zeien, Dee McGrath, Aaron Flugum and City Attorney Todd Prichard

Moved by Daly, seconded by Speltz; That the agenda be approved as amended. Ayes –Six. Nays – None. Absent –None. Motion carried.

Moved by Denner, seconded by Humpal; That the minutes of the regular council meeting of May 16, 2022, be approved. Ayes – Six. Nays – None. Absent –None. Motion carried.

Moved by McDonald, seconded by Denner; That the claims in the amount of $164,306.92 be approved. Ayes – Six. Nays – None. Absent – None. Motion carried.

Council Member Denner, moved seconded by Council Member Fisher; that the Ordinance for AMENDING THE CITY OF NEW HAMPTON FEE SCHEDULE, receive its second consideration, be approved Ayes – Humpal, McDonald, Speltz, Daly, Denner, Fisher. Nays – None. Absent – None. Motion Carried. Mayor Schwickerath directed the proposed ordinance be on the next regularly scheduled council meeting on June 20, 2022 for its third and final consideration.
Council Member Denner moved, seconded by Council Member Daly; that the cigarette/tobacco permits for Casey’s General Store, Fareway Stores, Kwik Star (115 East Main), Kwik Star (825 West Milwaukee) and Dollar General from July 1, 2022 through June 30, 2023, be approved. Ayes – Six. Nays – None. Absent – None. Motion carried.

Chief of Police Nosbisch has begun the process to hire a police officer to replace the recently resigned officer, but is looking for Council approval to hire once that candidate completes all the requirements. Application deadline is June 24, 2022. Moved by McDonald, seconded by Humpal; that Police Chief Nosbisch begin the application & hiring process to fill the vacant police officer position, be approved. Ayes – Six. Nays – None. Absent – None. Motion carried.

Police Chief Nosbisch is requesting the option to utilize comp time for the additional hours he will be working this summer. He is currently short one officer due to a recent resignation and there is a chance another staff member will be on medical leave. Moved by Fisher, seconded by Denner; that Police Chief Nosbisch be allowed to accumulate comp time as the staffing shortage in the police department continues with a revaluation in 6 months, by approved. Ayes – Six. Nays – None. Absent – None. Motion carried.

Moved by Denner, seconded by Speltz that the following items be approved for the Little Light of Mine Holiday Event on December 2nd & 3rd, 2022,
1. Closure of the two north entrances into Mikkelson Park from 4:00 pm – 9:00 pm for their holiday celebration on December 2nd & 3rd, 2022.
2. Close East Spring Street from 4th Avenue to Mikkelson Park
3. No parking allowed inside Mikkelson Park near the swimming pool and baseball dugout
4. Approve the Fireworks Permit for December 17, 2022

The discussion of the Capital Improvement Projects Plan was scheduled for June 6, 2022. Department heads were to complete the questionnaire in preparation for this meeting. Councilmember McDonald has requested this issue be discussed at the August 1, 2022 regularly scheduled council meeting.

Steve Troyer, engineer with Fox Strand & Associates presented information for the facility plan for the wastewater treatment plant and explained the timeline with the required Nutrient Reduction Strategy for IDNR Troyer recommends that the city request an extension until 2032 or 2036 to meet the requirements, our current facility is not capable of meeting the strict guidelines for phosphorous removal. With council approval, Troyer will present the IDNR response for approval at the June 20th 2022 council meeting

Moved by Daly, seconded by Fisher; that the Liquor License renewals for Schueth Ace Hardware, #WBN000520 and The Blue Iris, LLC, #BW0095820, be approved. Ayes – Six. Nays – None. Absent – None. Motion carried

Moved by Denner, seconded by Speltz; that the City Clerk’s office be approved to pay additional claims before the fiscal year end of June 30, 2022 and as budgets allow, be approved. Ayes – Six. Nays – None. Absent – None. Motion carried.

Public Works Director Casey Mai shared the results of the Board of Adjustment meeting. Kim Voss was requesting a variance for a side and rear yard setback for a shed, this request was denied. Patricia Ott and Susan Richter, both reside on Logan Ave, requested a Special Exception for their new buildings. Both requests were approved.

Mayor Schwickerath updated the council on the ambulance service. As of this week, the county Board of Supervisors is taking steps to purchase equipment from Chickasaw Ambulance service owner, Jeremy McGrath, using ARPA funds. There are several options to fund the ongoing expenses of the ambulance, an Iowa Code 422D county wide election which would allow a property tax, income tax surtax, or a combination of both. The City can also request the citizens to vote on Iowa Code 357G which would establish an Emergency Medical District. City Clerk Clemens also suggested the use of the Local Option Sales Tax (LOST). Currently LOST funds are directed only to city infrastructure projects. An election would need to take place to change the use of the revenues from infrastructure to ambulance funds, or a combination of both. After the next ambulance council meeting on June 15th, the city will have a better understanding on which direction the council should proceed.

Mayor Schwickerath shared the results of the Committee as a Whole regarding the adoption of a Code of Conduct. The council felt it was appropriate to adopt the code to encourage council members, city staff and board and commission members to keep in mind that the goal of all staff is comply with the letter and spirit of the laws and policies affecting the operations of government; public officials be independent, impartial and fair in their judgment and actions. A finalized copy will be presented at the June 20th council meeting.

Public Works Director Casey Mai is requesting direction regarding the dying ash trees in the city ROW. Street department staff is updating their inventory from their original inventory completed in 2021. Mai is estimated there are over 125 trees to add to the existing list. Street department staff does not have the time or equipment to remove the trees. Mai is requesting to ask for bids to remove the trees that pose the biggest liability. Mai will report back to the council once the inventory is complete.

Iowa Municipal Solutions owner, Chris Even, our WWTP contractor has once again requested to reduce his monthly agreement amount. The reductions in fees are due to two factors: 1. His familiarity with the plant & operations, and 2. Eric Kuehn working additional hours and assuming some of the duties. The initial annual fee was $93,600 and then reduced to $74,880 and now $51,996. An annualized savings of $40,000. Moved by McDonald, seconded by Fisher; to direct Mayor Schwickerath to sign the amended agreement that reduces the monthly contracted amount with Iowa Municipal Solutions $4,333 per month, be approved. Ayes – Six. Nays – None. Absent – None. Motion carried

Moved by Fisher; seconded by Denner; to close the alley between South Walnut and South Chestnut to allow Schueth Ace Hardware to hold their 100th Anniversary picnic on Wednesday, June 8, 2022, be approved. Ayes – Six. Nays – None. Absent – None. Motion carried.

Moved by McDonald, seconded by Fisher; that the minutes and correspondence be accepted and placed on file.

City Attorney Todd Prichard reported that the house at 103 East Bigelow will be torn down, hopefully in the next month.
