The City Council of the City of New Hampton met in regular session in the Council Chambers at 112 East Spring Street, New Hampton Iowa at 7:00 p.m. Monday, November 20, 2023. The meeting was called to order by Mayor Schwickerath at 7:00 p.m. Council members present were Humpal, McDonald, Porath, Speltz, Denner and Fisher. Also in attendance were Tim Pederson, Kristi Pederson, City Attorney Todd Prichard, Bob Fenske, Tara Hackman, Rick Kramer, Beth Eiler and Matt Kuhn of Homeland Energy and several NHHS government students.

City Clerk Karen Clemens shared information with the City Council regarding House File 718 which was passed by the State of Iowa Legislature last spring. This legislative action has greatly decreased a city government’s revenue generating abilities in addition to setting limitations on growth. Currently, the City utilizes three voter approved levies to fund the NH Public Library, the Carnegie Cultural Center and the maintenance expenses for the Community Center/City Hall building. The City Council has the discretion to use the revenues from these phased out levies toward any general fund department. Once the city receives the valuations in December, Clemens will have a better understanding of what the revenues will be for Fiscal Year 2024-2025.

Councilmember Cory McDonald presented an updated Capital Improvement Plan for council review. Several city departments submitted 52 capitals projects requests to improve their departments and improve the quality of life for New Hampton residents.

Councilmember Cory McDonald discussed the possibility of utilizing American Rescue Plan Act (ARPA) which have been dedicated to the TRIBE Trail Phase III project, be used for other city projects. TRIBE Trail committee representative Tara Hackman reminded the council that the City’s contribution of $200,000 to the Phase III project was necessary to receive several grants. Changing the contribution amount from the City would be detrimental to the status of the current grants but could also hurt the possibility of receiving future grants.

On November 13, 2023 the Iowa District Court for Chickasaw County submitted an Order for Case No. CVCV004370 City of New Hampton v. Precision of New Hampton. It was ordered that Precision of New Hampton was not guilty of municipal infractions; and the City of New Hampton does not have to issue a building permit for the proposed building. As a result of this Order, Prichard was informed by Precision of New Hampton’s attorney that Precision of New Hampton intends to move the storm sewer that is under their newly poured cement foundation. Prichard has prepared an agreement for all parties to sign. Moved by Fisher, seconded by Porath That Resolution No. 6600 A RESOLUTION DIRECTING MAYOR SCHWICKERATH TO SIGN AN AGREEMENT BETWEEN PRECISION OF NEW HAMPTON AND THE CITY OF NEW HAMPTON FOR THE RELOCATION OF A STORM SEWER MAIN, be approved. Ayes – Humpal, McDonald, Porath, Speltz, Denner, Fisher. Nays – None. Absent – None. Resolution approved,

Beth Eiler and Matt Kuhn, representatives from Homeland Energy, are requesting the City of New Hampton assist the company with a grant application with the Environmental Protection Agency (EPA). They are requesting the City be the applicant for the grant process, they will be the sub-recipient. Prichard was concerned about the specifics of the grant and how it could negatively affect the City of New Hampton. Prichard requested an indemnification agreement if the city council approves to continue with the request. To discuss this issue further, a special City Council meeting has been set for Wednesday, November 29, 2023 at 5:30 pm in the Council Chambers.
