The City Council of the City of New Hampton met in regular session in the council chambers at 112 East Spring Street on Monday, October 19, 2020 at 7:00 p.m.

The meeting was called to order by Mayor Schwickerath at 7:00 p.m. Council members present were Boos, Denner, Diiro, Kuhn. Perkins and McDonald were absent. Also in attendance were Zach Nosbisch, Tammy Robinson, Eric Kuehn, Jason Speltz and City Attorney Kevin Kennedy.

Moved by Diiro, seconded by Boos; The agenda be approved as presented. Ayes- Four. Nays – None. Absent – Perkins, McDonald. Motion carried.

Moved by Diiro, seconded by Kuhn; That the minutes of the September 21, 2020 regular Council meeting, be approved. Ayes- Four. Nays – None. Absent – Perkins, McDonald. Motion carried.

Moved by Kuhn, seconded by Denner; That claims in the amount of $120,430.36 be approved. Ayes- Four. Nays – None. Absent – Perkins, McDonald. Motion carried.

Moved by Kuhn, seconded by Boos; To direct Mayor Schwickerath to sign a proclamation in support of the Start By Believing public awareness campaign and that the City of New Hampton be declared a Start by Believing city, be approved. Ayes- Four. Nays – None. Absent – Perkins, McDonald. Motion carried.

Moved by Denner, seconded by Kuhn; the request of New Horizon Chamber to close North Walnut from Main Street to the alley from 8:00 am thru 3:00 pm on November 7, 2020 for the Holiday open house event, be approved. Ayes- Four. Nays – None. Absent – Perkins, McDonald. Motion carried.

City Clerk Karen Clemens presented a Fraud Reporting policy that needs to be approved by the council to be reimbursed by FEMA/Iowa Homeland Security for COVID19 related costs. This is a Federal requirement to request and receive reimbursements. Moved by Diiro, seconded by Denner; That Resolution No. 6447 RESOLUTION TO ADOPT A FRAUD REPORTING POLICY, be approved. Ayes- Boos, Denner, Diiro, Kuhn. Nays – None. Absent – Perkins, McDonald. Resolution adopted.

City Clerk Karen Clemens presented a Segregation of Duties policy that needs to be approved by the council to be reimbursed by FEMA/Iowa Homeland Security for COVID19 related costs. This is a Federal requirement to request and receive reimbursement. Moved by Kuhn, seconded by Boos; That Resolution No. 6448 RESOLUTION TO ADOPT A SEGREGATION OF DUTIES POLICY, be approved. Ayes- Boos, Denner, Diiro, Kuhn. Nays – None. Absent – Perkins, McDonald. Resolution adopted.

As directed by the City Council at the October 5, 2020 council meeting, a job description was developed for a newly created position of Public Works Director. The council needs to approve the job description and provide for funding the position. Moved by Denner, seconded by Diiro; That Resolution No.6449 A RESOLUTION TO APPROVE THE POSITION OF PUBLIC WORKS DIRECTOR, THE PUBLIC WORKS DIRECTOR JOB DESCRIPTION AND PROVIDING FUNDING FOR THE POSITION, be approved. Ayes- Boos, Denner, Diiro, Kuhn. Nays – None. Absent – Perkins, McDonald. Resolution adopted.

City Attorney Kevin Kennedy prepared a draft ordinance to amend the regulations for detached accessory buildings. Councilmember Boos requested some changes to the proposed ordinance that will allow accessory buildings to be no larger than 1,024 sq ft on a lot which the total square footage is under 13,333. Boos would also like to allow those properties that have the total square footage between 8,701 and 13,333 additional space for a smaller bldg, no larger than 10’x12’. There was also discussion about the residentially zoned lots in the 2 mile zone and how they may want larger buildings. It was determined that these situations could be handled by the Board of Adjustment. Moved by Denner, seconded by Boos; That an Ordinance entitled ‘AN ORDINANCE AMENDING REGULATIONS FOR DETACHED ACCESSORY BUILDINGS’ receive its first consideration. Ayes – Boos, Denner, Diiro, Kuhn. Nays – None. Absent – Perkins, McDonald. Mayor Schwickerath ordered the ordinance change request be placed on the agenda for the next regular council meeting for its second consideration.

Moved by Denner, seconded by Boos; That the application for Tax exemption under the City of New Hampton, Iowa Urban Revitalization Plan for Erin and Mike Erdman, be approved. Ayes- Four. Nays – None. Absent – Perkins, McDonald. Motion carried.

Moved by Kuhn, seconded by Diiro; That the Finance Reports for September 2020, be approved. . Ayes- Four. Nays – None. Absent – Perkins, McDonald. Motion carried.
